Barely few hours before the new travel ban signed by US President Donald Trump could get operational, a federal Judge in Hawaii has clamped an emergency halt on the order getting effective.

The legal tussle is likely to get transferred to the Circuit for Federal appeals and consequentially to the Supreme Court of the US.

The verdict was the most recent legal setback to the US administration’s efforts aimed at provisionally banning immigrants and refugees from six Muslim majority nations.

Derrick Watson, the US District Judge clamped an emergency halt to the new travel ban order in response to the legal suit filed by the Hawaii state which put forth arguments that the travel ban was a violation of the US constitution as it discriminated against the Muslims, quotes Indian Express.

On the other hand, Trump has said that the travel ban was necessary in the interest of national security and is not discriminative against any specific religion.

The new travel ban was signed by Trump on March 6 and was aimed at overcoming legal hurdles that ensued from an executive order signed in January that resulted in widespread protests and chaos at airports before a judge in Washington stopped the ban from being enforced in February.

It was concluded by Judge Watson in his ruling that though the executive order did not specify the term Islam, any objective and reasonable observer would infer that the travel ban was signed with the intention to disapprove a specific religion.

Commenting on the verdict Trump said that the legal hurdles are giving a weak appearance to the US administration and this was an extraordinary overreach of the judiciary. He added that the legal tussle would be taken as far as possible including the US Supreme Court.

The Speaker of the US House of Representatives from the Republican Party, Paul Ryan said that the travel ban was necessary for the betterment of inspection of the people arriving in the US. He also expressed confidence that the travel ban would be upheld by the higher courts in the US.
